Quick Answer

A personal injury claim in California arises when someone is harmed by another party's negligence under Civil Code §1714, which establishes the duty to use reasonable care. Most personal injury lawsuits must be filed within two years of the date of injury under Code of Civil Procedure §335.1. Medical malpractice claims have a separate three-year (or one-year-from-discovery) limit under CCP §340.5. Claims against California government entities must be presented within six months. Crown Law Firm represents injured clients across Fresno County and the Central Valley on a contingency-fee basis — no fee unless we recover.

California Statutes Governing Personal Injury Claims

These are the statutory provisions that most often control the outcome and timing of a Fresno County personal injury case.

Civil Code §1714

Duty of Care

"Everyone is responsible … for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person …" The statutory foundation for nearly every California negligence claim.

CCP §335.1

2-Year Statute of Limitations

Most personal injury actions — including car accidents, slip and falls, dog bites, and assault — must be filed within two years of the date of injury. Missing this deadline almost always bars the claim entirely.

CCP §340.5

Medical Malpractice Limits

Three years from the date of injury or one year from discovery of the injury, whichever comes first. For minors under age six, until their eighth birthday. MICRA also caps non-economic damages.

Government claims: If the at-fault party is a California state or local government entity (a city, county, or public agency), Government Code §911.2 requires an administrative claim within six months of the injury — far shorter than the standard two years. Fresno County and the City of Fresno are both subject to this rule.
